Lufthansa tweet to win contest - Official rules

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning. This contest is subject to all federal, state and local laws and regulations. Void outside the United States, in Puerto Rico and where prohibited by law.

2. ELIGIBILITY: All individuals who are legal U.S. residents who have reached the age of majority in the State in which they reside at the time of entry are eligible to enter the Contest. Employees, members of their households (whether related or not) and their immediate families (spouses, parents, siblings, children and each of their respective spouses), of Lufthansa German Airlines, its respective subsidiaries, affiliates and anyone involved in the promotion, development and handling of this Contest and any persons domiciled with any of the above are not eligible.

3. ENTRY PERIOD: The Contest will begin at 12:00:01 am Eastern Standard Time ("EST") on October 13, 2009 and will end at 11:59:59 pm EST on October 18, 2009 (the "Contest Period").

4. PRIZE: One (1) Grand Prize: One winner will be chosen to win the Grand Prize package for one (1) individual to participate in the Star Megado Experience. The trip package includes roundtrip air transportation (coach) from and to a Continental or Lufthansa U.S. gateway airport nearest winner's home, hotel accommodations (single occupancy), ground and air transportation to/from all sponsored events, welcome dinner, welcome party, tours of airport facilities sponsored by Continental, Lufthansa & Airbus, and meetings with top company executives. Applicable taxes, fees, airport charges, and carrier surcharges, including the September 11 Security Fee of up to $11 per flight segment are included in the Prize. A complete itinerary shall be provided to the winner.

Estimated value is $3,000. Actual retail value depends upon the winner’s point of departure, and existing rates at the time of travel, and any difference between the stated retail value and the actual value if any, will not be awarded.

Winner must be able to travel on dates specified by Sponsor or prize will be forfeited and an alternate winner selected at the discretion of the Sponsor. Travel arrangements will be made t on carrier(s) designated by Sponsor. Trip is subject to air/hotel availability and other conditions and restrictions, if provided by prize coordinator/supplier. If the winner lives within 100 miles of Newark, NJ, the air transportation portion of that trip will not be awarded and no additional compensation or substitution will be provided. The winner will be responsible for getting to/from Newark, NJ. Airline and flight times to be selected by air supplier at its sole discretion. One or more stopovers may be required on air transportation. Air transportation and hotel accommodations must be taken together and cannot be taken separately. No change, extension or substitution of trip dates is permitted. Sponsor shall not be responsible for any cancellations, delays, diversions, substitutions, or any acts or omissions whatsoever by the air carriers, hotels, or other transportation companies or any other persons providing any of these services and accommodations to passengers, including any results thereof, such as changes in services or accommodations necessitated by same. Prize conditions may be added or modified by companies providing those portions of the prize. The prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit and release and/or prize travel documents. Winner is responsible for obtaining travel documents, as well as travel insurance (and all other forms of insurance), that they may wish to obtain (at their own expense) and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. It is the responsibility of the winner to arrive at the designated U.S. gateway city in time for each flight. No substitutions, cash equivalents, or transfer of prize permitted except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of equal or greater value. All taxes, and any other costs and expenses associated with prize acceptance and use not specifically stated within these Official Rules as being provided, are the sole responsibility of the winner, including, without limitation, all federal, state, and local taxes, additional transportation, meals, gratuities, and souvenirs. Prize may not be transferred or substituted except at the Sponsor’s sole discretion. All prize details are at Sponsor’s sole discretion.

Winner must be at least the age of majority. The Prize winner will be responsible for all expenses not specifically stated as part of the Prize, including but not limited to, local transportation including air or ground transportation from the winner’s home to a CO or LH U.S. airport gateway, or if the winner lives within 100 miles of Newark local transportation to Newark, NJ, overnight accommodation prior to or following the travel dates in order to accommodate flight connections, income taxes, insurance, passport and visa costs, gratuities, meals, beverages, incidentals and any items of a personal nature. In the event of denied boarding, no compensation due by Lufthansa for costs directly or indirectly incurred. No mileage credit applicable. Winner is responsible for procuring adequate documentation for travel to IATA Europe. Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination. The approximate retail value of the Prize is US $3,000.

5. HOW TO ENTER AND WIN:

To enter this Contest, registered Twitter users shall (1) visit www.lufthansa-usa.com/tweettowin (the “Website”), (2) read and agree to the terms and conditions, and (3) submit an entry by sending a tweet including Lufthansa’s USA Twitter account name “@Lufthansa_USA” outlining why they should be selected to win the Grand Prize. To be eligible, entries must (1) contain the name of Lufthansa’s USA Twitter account (@Lufthansa_USA), and (2) be tweeted through the user’s Twitter account during the Contest Period. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply.

By successfully transmitting your tweet as directed, you will receive one (1) entry into the Contest. Limit of one (1) entry per person, per Twitter username. If an entrant uses multiple Twitter usernames to submit more than one entry during the Contest Period, only the first entry received may be entered into the Contest.

By entering this Contest you acknowledge that you have read and understood and agree to be bound by these terms and conditions.

Entries will be made by the authorized account holder of the Twitter username submitted at time of entry. The authorized account holder is deemed as the natural person who is assigned to a username registered with Twitter.com.

Proof of sending will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods and such senders. Incomplete, inaccurate, or incorrect entries are void.

No other form of entry will be accepted. Any person who attempts to participate with multiple e-mail addresses, under multiple identities, or uses any device or artifice to enter multiple times in violation of the preceding entry limitation will be disqualified. Any use of robotic, automatic, macro, programmed, or like (online) entry methods will void all such entries by such methods and result in disqualification of any entrant using such methods.

6. A winner will be chosen based upon creativity of tweet content by employees or representatives of Sponsors, whose decisions are final and binding with respect to all matters related to the Contest. Odds of winning will depend upon the number of eligible entries received during the Contest period.

7. The Contest will end on at 11:59:59 p.m. Eastern time on October 18, 2009. The winner will be notified by direct message on Twitter within 1 business day after the end of the Contest period. The confirmation will state that the selected entrant has read, understood, and complied with the rules and regulations of the Contest, and that he/she accepts the Prize as offered.

If the winner does not respond within 48 hours of transmission, or if the winner does not comply with the Contest Terms and Conditions, that winner forfeits any right to the Prize and another random winner will be selected. The Prize is not transferable or convertible to cash and must be accepted as awarded.

The selected entrant may be requested to provide Lufthansa with proof that he/she is the authorized account holder of the phone number or e-mail address associated with the winning entry and will be required to furnish proof of eligibility (including, without limitation, proof of United States residency, and age) as a condition of receiving the Prize.

8. Lufthansa is not responsible for failure for any reason whatsoever of the selected entrant to receive notification. Arrangements for the fulfillment of the Prize will be handled by Lufthansa. Lufthansa reserves the right in their sole discretion to substitute any and all part of the Prize with a Prize of comparable value.

9. In order to be eligible to win the Prize, the selected entrant must authorize Lufthansa to announce and publish his/her name, location, and Twitter username in any publicity. In addition, the selected entrant will be required to sign a declaration of compliance with the Contest Terms and Conditions and one or more releases to obtain the Prize.

10. Lufthansa is not responsible for any injury or damage to entrant’s or any other person’s computer system, property or anything stored on or related thereto as a result of participation in, or connection with, this drawing and entrant hereby releases Lufthansa from all liability in connection with the Contest and any Prize won. The selected entrant must, in order to be eligible to win the Prize, sign a discharge of liability form acknowledging non-responsibility of Lufthansa in respect to injuries, accidents, loss, or misfortune relating to the drawing and/or the awarding of the Prize. Failure to comply with all the Contest rules or to sign and return any of the release forms will result in disqualification and selection of the most creative of the remaining entries. A selected entrant will be declared a winner only after meeting all of the above terms and conditions.

11. Lufthansa is not responsible for error, omission, interruption, deletion, delay in operation or transmission or unauthorized access to or alterations of the Contest, or for technical, equipment, network, electronic, computer, hardware or software malfunction or inaccurate transmission of or failure to receive entry by Lufthansa, even if it affects ability to enter or entry into this Contest. Lufthansa is also not responsible for lost, stolen, misdirected, delayed, destroyed or illegible entries. All submissions become the property of Lufthansa and will not be returned.

12. The decisions of Lufthansa for the winner will be final and binding. By participating, entrants agree that they have read, understood and agree to these Contest rules and regulations and release Lufthansa from all liability in connection with the game and/or any Prize. Prize is subject to all applicable Federal, State and Municipal taxes which are the responsibility of the winner.

13. Lufthansa reserves the right to amend or terminate all or any portion of this contest at any time without prior notification. Lufthansa reserves the right to substitute a Prize of equal or greater value in the event of non-availability of the Prize for any reason. Void where prohibited.

14. GOVERNING LAW: This Contest shall be governed by the laws of the State of New York, USA (without regard to principles of conflict of laws), with venue and jurisdiction Nassau County, NY and all claims must be resolved in the courts located in Nassau County, NY, except as required by law.

15. This travel award may not be combined with or applied to other certificates, promotions or special offers, including, but not limited to; upgrades, government fares, tour/travel packages, group, convention/company meetings fares, bereavement, companion fares, senior citizen discounts, corporate agreements, student fares, child fares, travel industry discounts, internet fares, frequent flyer programs or any unpublished programs.

16. WINNERS LIST: The winner will be publicly announced on Lufthansa’s USA Twitter account at http://www.twitter.com/Lufthansa_USA within 30 days after the end of the Contest period.
